These Terms of Use (or “Terms”) govern your access and use of the Blockbilby Service (the “Service”), except where expressly stated otherwise, and provide information about the Blockbilby and its policies. These Terms constitute an agreement between you and the individual or individuals operating Blockbilby (“Blockbilby”, “we”, “us”, or “our”). If you do not agree to these Terms, please do not use or access Blockbilby.
These Terms are effective as of 1 May 2026. If you have any questions regarding these Terms or wish to submit a formal notice, claim, or inquiry, you may contact us at hello@blockbilby.com. We reserve the right to assign or transfer our rights and obligations under these Terms at any point in time.
These Terms, along with any policies or documents that have been included by reference, including without limitation the Privacy Policy and Community Guidelines, make up the entire agreement between you and Blockbilby in relation to the Service and supersede all prior or contemporaneous agreements, communications, representations, or understandings, whether written or oral. You acknowledge that you have not relied on any statement, representation, or warranty not expressly set forth in these Terms in the decision you have made to use the Service.
If you are below the age of majority in your jurisdiction, you represent that you have the consent and authority of a parent or legal guardian of such an age, and that they have agreed to these Terms on your behalf.
“Service”: The Blockbilby platform including without limitation its website, applications, tools, and services.
“User”: Any individual who uses or accesses the Service.
“Account”: A registered profile created to use or access the Service.
“Content”: Any material created, uploaded, submitted, or shared through the Service, including without limitation code, metadata, projects, images, and text.
“User Content”: Content created, uploaded, or shared by Users.
“Creative Works”: Works, projects, or outputs created by Users through or shared through the Service.
“Content Moderation”: The actions we take to ensure the safety of the community, including without limitation the review of Content and Accounts.
“Termination”: The ending of this Agreement between you and Blockbilby, whether initiated by you or by us.
“Suspension”: The temporary restriction or disabling of access to the Service or an Account without terminating this Agreement.
“Third-Party Services”: External services or platforms not operated by Blockbilby but integrated with or accessible through the Service.
“Community Guidelines”: A separate policy governing acceptable behavior and content standards, including what you can and can’t share.
“Personal Data”: Any information relating to an identified or identifiable individual.
This contract is governed and constructed in accordance with the laws of Australia without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within the Governing Jurisdiction of New South Wales, Australia for the resolution of any disputes arising out of or relating to this Agreement.
The failure or delay by either party to exercise a right or remedy under this Agreement shall not constitute or be interpreted as a waiver of that right or remedy, nor shall it prevent its exercise in relation to any past, concurrent, or future breach of this Agreement.
If any provision of this Agreement is found by a court of the governing jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed severed from this Agreement, and the remaining provisions shall continue in full force and effect.
We may update our terms and policies from time to time to accurately reflect changes to our Service, its policies, or legal requirements. When we do, we will revise this page to reflect the latest version and, where appropriate, provide additional notice through channels such as email or through the Service.
The most current version of these Terms will always be available on this page. By continuing to access or use the Service after any updates become effective, you agree to be bound by the revised Terms.
In the event that the Terms of Service available at this link conflict with the Terms or Policies found elsewhere, the Terms of Service at this link shall take precedence unless otherwise noted.

We do not knowingly permit individuals under 13 years of age to use the Service, nor do we knowingly collect their data. If we become aware that a user is under 13 years of age, we may suspend or delete the account and associated data.
As a user, you have the responsibility to ensure the content you create, whether public or not, meets our strict Community Guidelines, complies with these Terms and follows applicable laws.
You may not, whether directly or indirectly, upload to the Service, publish, create, or otherwise share inappropriate content, including without limitation, adult, obscene, illegal, hateful, or otherwise offensive and/or harmful content or any content that violates the rights of others, including without limitation, intellectual property and privacy rights.
These restrictions apply to all mediums throughout the Service and its affiliated channels, including without limitation, projects, artworks, comments, biographies, avatars, thumbnails, metadata, usernames, and support channels.
We reserve the right to, at our sole discretion, deem any content to be in violation of these restrictions and take appropriate action.
You warrant that you own the rights to the content that you create and/or upload and agree to indemnify, defend, and hold harmless Blockbilby, its operators, contributors, and service providers, from and against any claims or action that may arise from the content you upload to the Service.
While we strive to maintain a safe community through automated and manual moderation, content screening, and user reports, there may be rare occasions where some inappropriate content bypasses these measures. Blockbilby does not guarantee the screening of all user-generated content and accepts no liability for such content.
By uploading or creating content through or on the Service, you grant Blockbilby a worldwide royalty-free license to host, distribute, modify, run, and create derivatives of your creative works.
You may terminate this license at any time by deleting your content or account, however this license may continue to the extent your content has been shared with or incorporated into works of others, including but not limited to, remixes and collaborations and for a reasonable period for archival or backup purposes.
Blockbilby and/or its licensors retain all rights, title, and interest in the Service, including without limitation, its software, algorithms, and branding. These assets are protected by the relevant copyright, trademark, and other related proprietary rights laws, both domestic and international.
Unless otherwise explicitly permitted, your use of these assets is limited to purposes solely relating to your personal, non-commercial engagement with the Service as a current or prospective user. You may not copy, modify, publicly display, reproduce, sell, or transmit any of the material and assets provided to you through the Service, with the exception of creating derivatives of creative works solely within the Service with respect to all other Terms and provisions of this Agreement. Furthermore, you may not delete, alter, or otherwise modify the copyright, trademark, or any other proprietary rights notices from copies of the materials of the Service.
However, in instances where you are in compliance with these Terms, you are permitted to use elsewhere, including on other sites and forms of media, unaltered copies of publicly available branding of the Service for the limited, non-commercial, and personal use of discussions relating to such content under the provision that its usage and distribution is compliant with these Terms and the original proprietary rights notices of the copies of such content and assets are included in a preserved and unmodified state with sufficient attribution to the Service and its operators, contributors, and service providers.
We respect international intellectual property rights and expect users of the Service to do the same. If you believe that content available on the Service infringes your intellectual property rights under applicable law, you may submit a notice to us including the following information:

Upon receipt of a valid notice, we’ll review it within a reasonable timeframe and may remove or disable access to the allegedly infringing content and notify the user who posted it.
If you believe that your content has been removed or disabled as a result of mistake or misidentification, you may submit a counter-notice including:

Upon receipt of a valid counter-notice, we’ll review it within a reasonable timeframe and may restore the content if we determine it to not infringe intellectual property rights.
We reserve the right to suspend or terminate accounts of users who repeatedly infringe intellectual property rights or violate this policy. Likewise, submitting false or abusive claims of intellectual property right infringements may result in action.
You are responsible for the activity that occurs under your account and for maintaining the security and confidentiality of your account, its credentials, its sessions, and its authentication tokens. If you suspect any unauthorized access or use of your account, you must notify us immediately.
We reserve the right to suspend, restrict, or remove your account if we, in our sole discretion, believe it has been compromised or is being used in violation of these Terms or for security purposes.
You agree not to create, sell, or use multiple accounts to gain unauthorized benefits or to circumvent restrictions, bans, or enforcement actions.
The Service may contain links to or integrate with third-party websites or services (e.g., cloud storage, authentication providers). Your use of such third-party services is governed by their respective terms and policies.
We do not control, endorse, or assume responsibility for any third-party services, websites, content, or practices. Your access to and use of third-party services is at your own risk. Such links and integrations are provided without warranties of any kind.
We retain the rights to remove and take appropriate action on any content you share through the Service in the event that we deem it to be in violation of the Terms or Policies of the Service, or we are required to do so by law.
In accordance with Clause 2.3, Blockbilby is not to be held responsible for any losses that may arise from these actions, including without limitation any loss of data, creative works, or time.
Content you delete from the platform may persist for a limited period of time in cached or backup copies and may still be visible to others to the extent that it has been shared with or incorporated into works of others, as set forth in Clause 2.5.
You acknowledge that once content is shared, it may persist on the Service or elsewhere beyond our control and agree that we are not responsible or liable for the removal of content from the accounts of other users or third-party platforms.
In the event that this contact is terminated, or your account is deleted, disabled, or suspended, whether by choice or as a result of moderation actions, certain clauses of this Agreement will persist in perpetuity as set forth in Clause 7.2.
Blockbilby is not to be held responsible for any losses or claims arising from the removal of content that you have uploaded or shared through the Service, regardless of the acting party.
The removal of any content by Blockbilby does not limit or waive your obligation to indemnify, defend, and hold harmless Blockbilby, its operators, contributors, and service providers, for such content, as set forth in Clause 2.3.
We reserve the right to ban, terminate, suspend, or restrict your account or your access to the Service at our sole discretion in the event that we deem you to be in violation of this Agreement, or any agreed Terms or Policies. In the event of such termination, the provisions regarding survival and perpetuity set forth in Clause 7.2 shall apply.
At our sole discretion, and unlike termination, a suspension or restriction is remedial and reversible and may be used to allow for a period of review or for a user to come back into compliance with these Terms. Under no circumstance does a suspension or restriction guarantee any form of reinstatement, nor does it prejudice any final determination, further actions, or our right to subsequently terminate your account or this Agreement for the same or additional violations.
In the event that your account or access to the Service is suspended or restricted as a reversible measure, you will still be bound by the Terms of this Agreement, its policies, and any relevant agreements. During this period, the agreements, terms, and policies remain in full force and effect, and you remain obligated to comply with all such terms, including the prohibition against bypassing enforcement measures as set forth in Clause 2.2.
The information and content you upload will be treated in accordance with the Privacy Policy. By accessing or using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.
If you are a parent or legal guardian providing consent on behalf of a minor, you acknowledge that you have reviewed and agree to the Privacy Policy on their behalf.
The Privacy Policy is incorporated into these Terms by reference and forms part of this Agreement. In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy shall prevail with respect to matters relating to personal data.
Blockbilby offers a core set of features free of charge for individual users. We may, at our sole discretion, introduce additional paid features, subscriptions, or services.
We may also offer paid plans, licenses, or subscriptions for individuals or organizations, including but not limited to schools, educational institutions, and other entities, which may provide additional features or usage rights.
Access to additional features, subscriptions, services, usage rights, or plans may require payment of applicable fees, which will be clearly disclosed prior to purchase. The availability, scope, and pricing of such features and plans may change from time to time.
Unless otherwise stated, the core functionality of the Service will remain available free of charge to individual users.
The Service is provided on an “as-is” and “as-available” basis. While we aim to have our Service available to the best of our ability, under no circumstance does Blockbilby, its operators, contributors, or service providers make any warranty, expressed or implied, relating to the Service's reliability, uptime, or availability, nor do we make any guarantee of response times, support availability, or service levels. We reserve the right to modify, suspend, or discontinue our services at any point in time without notice.
To the extent permitted by the law, Blockbilby, its operators, contributors, and service providers disclaim all warranties, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement and are not to be held liable for any damages, including without limitation direct, indirect, consequential and punitive damages arising from your connection to, relation with, or usage of the Service, including but not limited to data loss, moderation actions, and downtime.
While we strive to create a secure, safe, and inclusive community, we do not warrant that the Service will meet your requirements, that content will be accurate or reliable, or that the Service will be free from harmful content.
To the maximum extent permitted by applicable law, Blockbilby, its operators, contributors, and service providers shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including without limitation loss of profits, loss of data, or service interruption, arising out of or in connection with your use of, or inability to use, the Service.
To the extent permitted by law, The total liability of Blockbilby, its operators, contributors, and service providers for all claims shall not exceed the amount you have paid directly to Blockbilby in the past twelve months preceding the claim. If you have not paid any amount, Blockbilby, its operators, contributors, and service providers shall have no monetary liability to the maximum extent permitted by applicable law.
Blockbilby, its operators, contributors, and service providers are not to be liable for any failure or delay in the performance of the Service caused by events beyond our reasonable control, including without limitation natural disasters, internet or telecommunications failures, cyberattacks, government actions, labor disputes, war, riots, pandemics, or failures of third-party services or infrastructure.
During such events, our obligations under these Terms will be suspended for the duration of the force majeure event, and we will resume performance as soon as reasonably practicable.
You represent and warrant that you are not located in, under the control of, or a national or resident of any country or region subject to applicable trade sanctions or embargoes, and that you are not listed on any government list of prohibited or restricted parties.
You agree to comply with all applicable export control and sanctions laws and regulations, including those of Australia, in your use of the Service. You may not use or access the Service if such use would violate applicable export or sanctions laws.
You indemnify, defend, and hold harmless Blockbilby, its operators, contributors, and service providers from and against any claims, liabilities, damages, and expenses arising out of or relating to your breach of this clause.
You acknowledge and agree that the use of the Service is at your own risk, including with respect to the storage, retention, and integrity of any data, content, or materials you upload, create, or otherwise make available through the Service.
While we implement measures to protect and preserve data, under no circumstances do we guarantee that any data will be stored, retained, or recoverable for any period of time, nor are we liable for any loss, corruption, or deletion of data.
You are solely responsible for maintaining appropriate backups of your data and content.
To the maximum extent permitted by applicable law, Blockbilby, its operators, contributors, and service providers shall not be liable for any loss of data, loss of content, or any resulting damages, including without limitation loss of profits, revenue, or opportunities, arising out of or in connection with your use of, or inability to use, the Service.
Blockbilby may, in its sole discretion, at any time, terminate or limit your access to the Service, its site, its applications, and any content hosted on or provided through it.
This Agreement shall be considered terminated when any of the following events occur:
In the event that this contract is terminated, these Terms shall terminate as an agreement between you and us, with the exception of the following clauses which will apply in perpetuity, even after termination:
Upon termination of this Agreement, your right to access and use the Service will immediately cease. We may suspend, disable, or delete your account and remove or restrict access to your content and data.
You acknowledge that content you have shared or that has been incorporated into the works of other users may continue to exist and be accessible on the Service.
We may retain certain information as required for legitimate business purposes, legal obligations, dispute resolution, or enforcement of these Terms, in accordance with our Privacy Policy.
Under no circumstance will we be under any obligation to store, maintain, or provide copies of your content or data after termination.
By entering into these Terms, you agree to release and hold harmless Blockbilby, its operators, contributors, and service providers, from and against all liabilities, losses, claims, expenses, damages, and penalties, including without limitation, attorneys’ fees, or losses arising out of or in relation to:
including to the extent that such actions cause or contribute to Blockbilby being in breach of obligations to third-party providers or services.
